Legislative instruments

Legislative instruments are secondary legislation that are made by someone other than Parliament or under a power that Parliament has formally delegated in a particular Act. Secondary legislation includes regulations, rules and orders in council.

Enforcement policy

We are responsible for administering cultural and heritage legislation. We have a responsibility to enforce provisions of these Acts by investigating possible breaches and taking appropriate action. This includes prosecuting offences where we determine it to be in the public interest after we have analyse everything relevant to the that breach.

The Flags, Emblems, and Names Protection Act 1981 restricts the use of wording and emblems associated with the 28th Māori Battalion and the 28th Māori Battalion Association.

Use of the word ‘Anzac’ guidelines

Section 17 of the Flags, Emblems, and Names Protection Act 1981 prohibits the use of the word ‘Anzac’ in trade or business. We provide guidance as to what uses of the word will generally not be in breach of the Act. Our guidance is not legal advice.
